Additionally, approximately 50,000 children of these spouses may also be eligible. This policy change aims to reduce the uncertainty and fear that many immigrant families face and ensure that family unity is prioritized within the immigration system.

To be eligible for this process, individuals must be present in the United States without admission or parole, have been continuously present for at least ten years as of June 17, 2024, and have a legally valid marriage to a U.S. citizen. They must also have no disqualifying criminal history and pose no threat to national security or public safety. Noncitizen children may also be considered for parole if they are physically present in the United States and have a qualifying stepchild relationship with a U.S. citizen. Interested individuals will need to file a form with USCIS, provide supporting documentation, and pay a fee. USCIS will assess each request on a case-by-case basis, ensuring the integrity of the program through robust fraud prevention measures.
